法律翻译——学校应当负起责任

　　University authorities should try to solve problems concerned with students' education and not shirk from them, says an article in China Times. An excerpt follows：

　　It is reported that the Institute of Foreign Studies under Henan Agricultural University recently signed a contract with its students stipulating that the school would be free of any legal responsibility resulting from such acts as mob fights, self-mutilation and suicide.

　　The contract is meaningless as, according to relevant laws, students are held completely accountable for their own behaviour if they have reached legal age.

　　The school authorities said the reason it drafted the contract was to stop endless quarrels and trouble from students' parents when such incidents occurred.

　　From the perspective of the school authorities, such a contract may possibly help reduce its management cost. However, this also demonstrates its attitude towards facing its social duties. It also reflects the school's twisted educational ideas and intentions to shun possible risks.

　　It is not only the school's duty, but also its obligation to put students under good guidance and protection. As a place to give students knowledge and to teach them how to be a good person, the university should not shirk its duties to students even if they are legally responsible for themselves. When students study and live at a school, that school should maintain educational standards and personal safety.

　　An underlying reason for the greatness of education, to some degree, lies in teachers' relentless efforts to guide students.

　　It is true that during the country's transitional period, certain negative social elements have developed in our universities.

　　It is not rare to see such things as mob fights, which are eroding our formerly pure campuses. Facing such misconduct, school authorities should actively investigate these incidents and try to improve the situation.

　　China Times中的一篇文章谈到,大学的管理层应当设法处理与学生教育相关的问题而不是逃避问题。摘录如下：

　　河南农业大学留学生协会近日与学生签定了一份合同,规定学校对诸如聚众滋事、自残以及自杀行为导致的结果不负任何法律责任。

　　根据我国的相关法律，学生到了法定年龄应当对自己的行为负有完全的责任，那么这份合同就显得毫无意义。

　　校方说,起草这份合同是为了避免当此类事件发生时与学生家长之间无休止的争吵和麻烦。

　　给予学生正确的引导和有效的保护不仅是学校的义务也是其不可推卸的责任。即使学生能够在法律上为自己负责，作为一个能给予学生知识和教育学生成长为一个好人的场所学校不应当逃避自已的职责。学生学习和生活在学校里时，学校应当提供一流的教育,维护人身的安全。

　　从某种程度上说,教育的伟大其根本就在于老师持续不断的引导。

　　我们的国家目前正处在社会发展的过渡时期，一些负面的社会因素在大学里逐渐滋生也是不争的事实。

　　与我们先前纯净的校园相比，诸如聚众滋事等现象已不罕见。面对这些不正当的行为，学校的管理者应当积极地调查研究这些事件，以设法改善不良的局面。
