第六章  法律责任

Chapter VI Legal Liabilities

 

第五十一条  县级以上人民政府有关部门发现破坏湿地的违法行为或者接到对违法行为的举报，不予查处或者不依法查处，或者有其他玩忽职守、滥用职权、徇私舞弊行为的，对直接负责的主管人员和其他直接责任人员依法给予处分。

Article 51 If the relevant departments of the people's governments at or above the county level discovers any illegal act of destroying wetlands or receives a report on the illegal act, and fails to investigate or deal with it according to law, or has other acts，such as dereliction of duty, abuse of power, or malpractice for personal gains, the directly responsible person in charge and other directly responsible persons shall be punished according to law.

　　第五十二条  违反本法规定，建设项目擅自占用国家重要湿地的，由县级以上人民政府林业草原等有关主管部门按照职责分工责令停止违法行为，限期拆除在非法占用的湿地上新建的建筑物、构筑物和其他设施，修复湿地或者采取其他补救措施，按照违法占用湿地的面积，处每平方米一千元以上一万元以下罚款；违法行为人不停止建设或者逾期不拆除的，由作出行政处罚决定的部门依法申请人民法院强制执行。

Article 52 If the provisions of this Law is violated and a construction project occupies nationally important wetlands without authorization, the relevant competent departments of forestry and grassland of the people's governments at or above the county level shall order the offender to stop the illegal act according to their respective responsibilities, demolish the newly built buildings and other facilities on the illegally occupied wetlands within a time limit, restore wetlands or take other remedial measures, and fine the offender based on the illegally occupied wetland area at 1,000 - 10,000 yuan per square meter. If the offender does not stop construction or fails to demolish it within the time limit, the competent department that decided the administrative penalty shall apply to the people's court for compulsory execution according to law.

　　第五十三条  建设项目占用重要湿地，未依照本法规定恢复、重建湿地的，由县级以上人民政府林业草原主管部门责令限期恢复、重建湿地；逾期未改正的，由县级以上人民政府林业草原主管部门委托他人代为履行，所需费用由违法行为人承担，按照占用湿地的面积，处每平方米五百元以上二千元以下罚款。

Article 53 If a construction project occupies important wetlands and fails to restore or rebuild the wetlands in accordance with the provisions of this Law, the competent forestry and grassland departments of the people's government at or above the county level shall order the offender to restore and reconstruction the wetlands within a time limit. If the restoration and reconstruction is not finished within a time limit, the competent department of forestry and grassland entrusts others to conduct the restoration and reconstruction on the offender's behalf, and the required expenses shall be borne by the offender, and a fine of 500-2,000 yuan per square meter shall be imposed on the basis of the area of the occupied wetlands.

　　第五十四条  违反本法规定，开（围）垦、填埋自然湿地的，由县级以上人民政府林业草原等有关主管部门按照职责分工责令停止违法行为，限期修复湿地或者采取其他补救措施，没收违法所得，并按照破坏湿地面积，处每平方米五百元以上五千元以下罚款；破坏国家重要湿地的，并按照破坏湿地面积，处每平方米一千元以上一万元以下罚款。

Article 54 If the provisions of this Law are violated with the reclamation or landfilling of natural wetlands, the departments of forestry and grassland and other relevant competent departments of the people's government at or above the county level shall, in accordance with the division of duties and responsibilities, order the offender to stop its illegal activities, to restore the wetlands within a time limit, or to take other remedial measures, confiscate its illegal gains, and impose a fine of 500-5,000 yuan per square meter based on the area of ​​the damaged wetland. If the nationally important wetland is damaged, a fine of 1,000 - 10,000 yuan per square meter will be imposed according to the area of ​​the damaged wetland.

违反本法规定，排干自然湿地或者永久性截断自然湿地水源的，由县级以上人民政府林业草原主管部门责令停止违法行为，限期修复湿地或者采取其他补救措施，没收违法所得，并处五万元以上五十万元以下罚款；造成严重后果的，并处五十万元以上一百万元以下罚款。

If the provisions of this Law are violated, and the natural wetlands are drained or their water sources are permanently cut off, the competent forestry and grassland departments of the people's governments at or above the county level shall order the offender to stop the illegal act, restore the wetlands within a time limit or take other remedial measures, confiscate its illegal gains, and impose a fine of 50,000 - 500,000 yuan; and if serious consequences are caused, a fine of 500,000 -1 million yuan shall be imposed.

　　第五十五条  违反本法规定，向湿地引进或者放生外来物种的，依照《中华人民共和国生物安全法》等有关法律法规的规定处理、处罚。

Article 55 Anyone who violates the provisions of this Law by introducing or releasing alien species into wetlands shall be dealt with and punished in accordance with the "Biosafety Law of the People's Republic of China" and other relevant laws and regulations.

第五十六条  违反本法规定，在红树林湿地内挖塘的，由县级以上人民政府林业草原等有关主管部门按照职责分工责令停止违法行为，限期修复湿地或者采取其他补救措施，按照破坏湿地面积，处每平方米一千元以上一万元以下罚款；对树木造成毁坏的，责令限期补种成活毁坏株数一倍以上三倍以下的树木，无法确定毁坏株数的，按照相同区域同类树种生长密度计算株数。

 

Article 56 Anyone who violates the provisions of this Law by digging ponds in a mangrove wetland shall be ordered by the relevant competent departments of forestry and grassland of the people's governments at or above the county level to stop the illegal act, repair the wetland or take other remedial measures within a time limit. For the wetland area, a fine of 1,000 - 10,000 yuan per square meter shall be imposed; if trees are damaged, they shall be ordered to replant within a time limit 1 to 3 times the number of the damaged trees. If the number of the damaged trees cannot be determined, it can be calculated and determined based on the growth density of the same tree species in the same region.

　　违反本法规定，在红树林湿地内投放、种植妨碍红树林生长物种的，由县级以上人民政府林业草原主管部门责令停止违法行为，限期清理，处二万元以上十万元以下罚款；造成严重后果的，处十万元以上一百万元以下罚款。

Anyone, in violation of the provisions of this Law, releases or plantes species that hinder the growth of mangroves in mangrove wetlands shall be ordered by the competent forestry and grassland departments of the people's governments at or above the county level to stop the illegal act, to clean up these introduced species within a time limit, and to pay a fine of not less than 20,000 - 100,000 yuan; If the consequences are serious, a fine of 100,000 – 1 million yuan shall be imposed.

第五十七条  违反本法规定开采泥炭的，由县级以上人民政府林业草原等有关主管部门按照职责分工责令停止违法行为，限期修复湿地或者采取其他补救措施，没收违法所得，并按照采挖泥炭体积，处每立方米二千元以上一万元以下罚款。

Article 57 Anyone who collects peat in violation of the provisions of this Law shall be ordered by the competent departments of forestry and grassland of the people's governments at or above the county level, in accordance with their respective responsibilities, to stop the illegal act, to repair the wetland or to take other remedial measures within a time limit. The offender's illegal gains shall be confiscated, and a fine of 2,000 - 10,000 yuan per cubic meter shall be imposed based on the volume of peat that has been collected.

　　违反本法规定，从泥炭沼泽湿地向外排水的，由县级以上人民政府林业草原主管部门责令停止违法行为，限期修复湿地或者采取其他补救措施，没收违法所得，并处一万元以上十万元以下罚款；情节严重的，并处十万元以上一百万元以下罚款。

Anyone who violates the provisions of this law and discharges water from peat swamp wetlands shall be ordered by the competent forestry and grassland department of the people's governments at or above the county level to stop the illegal act, to restore the wetland or take other remedial measures within a time limit. The offender's the illegal gains shall be confiscated, and a fine of 10,000 - 100,000 yuan be imposed. If the circumstances are serious, a fine of 100,000 – 1 million yuan shall be imposed.　　

第五十八条  违反本法规定，未编制修复方案修复湿地或者未

按照修复方案修复湿地，造成湿地破坏的，由省级以上人民政府林业草原主管部门责令改正，处十万元以上一百万元以下罚款。

Article 58 Anyone who violates the provisions of this Law by failing to formulate a restoration plan to restore wetlands or failing to restore wetlands in accordance with the restoration plan, thus causing damage to wetlands, shall be ordered to make corrections by the competent departments of forestry and grassland of the people's governments at or above the provincial level, and a fine of 100,000 – 1 million yuan shall be imposed.

　　第五十九条  破坏湿地的违法行为人未按照规定期限或者未按照修复方案修复湿地的，由县级以上人民政府林业草原主管部门委托他人代为履行，所需费用由违法行为人承担；违法行为人因被宣告破产等原因丧失修复能力的，由县级以上人民政府组织实施修复。

Article 59 If the offender who destroyed the wetland fails to restore the wetland within the prescribed time limit or in accordance with the restoration plan, the competent forestry and grassland departments of the people's governments at or above the county level shall entrust others to conduct the restoration operation, and the required cost shall be borne by the offender. If a person loses the ability to repair due to being declared bankruptcy or other reasons, the people's governments at or above the county level shall organize the restoration operation.

　　第六十条  违反本法规定，拒绝、阻碍县级以上人民政府有关部门依法进行的监督检查的，处二万元以上二十万元以下罚款；情节严重的，可以责令停产停业整顿。

Article 60 Anyone who, in violation of the provisions of this Law, refuses or obstructs the supervision and inspection carried out by the relevant departments of the people's governments at or above the county level shall be fined 20,000 - 200,000 yuan; if the circumstances are serious, it may be ordered to suspend production and business for rectification.

　　第六十一条  违反本法规定，造成生态环境损害的，国家规定的机关或者法律规定的组织有权依法请求违法行为人承担修复责任、赔偿损失和有关费用。

Article 61 Anyone who, in violation of the provisions of this Law, causes damage to the ecology and environment, the organizations that are authorized by the state or the organizations that are regulated by law shall have the power to request the offender to assume the responsibility for restoration, compensation for losses and related expenses according to law.

　　第六十二条  违反本法规定，构成违反治安管理行为的，由公安机关依法给予治安管理处罚；构成犯罪的，依法追究刑事责任。

Article 62 Anyone who, in violation of the provisions of this Law, constitutes a violation of public security administration, the public security organ shall impose a public security punishment according to law; if the violation constitutes a crime, criminal responsibility shall be investigated according to law.

 

第七章 附  则

Chapter 7  Supplementary Provisions    

 

　　第六十三条  本法下列用语的含义：

Article 63 The meanings of the following terms in this Law are as follow:

　　（一）红树林湿地，是指由红树植物为主组成的近海和海岸潮间湿地；

1. Mangrove wetlands refer to offshore and coastal intertidal wetlands mainly composed of mangrove trees;

　　（二）泥炭沼泽湿地，是指有泥炭发育的沼泽湿地。

2. Peat swamp wetlands refer to swamp wetlands with peat development.

　　第六十四条  省、自治区、直辖市和设区的市、自治州可以根据本地实际，制定湿地保护具体办法。

Article 64 Provinces, autonomous regions, municipalities directly under the Central Government, cities that govern districts, and autonomous prefectures may formulate specific measures for wetland protection based on local conditions.

　　第六十五条  本法自2022年6月1日起施行。

Article 65 This Law shall come into force on June 1, 2022.
