Where there's no law, there's no life

A few years ago, I was shocked when I heard one conversation: In Australia, if the relationship break up  after you have lived together with one boyfriend or girlfriend for  a couple of years, then the rich side will lose half property by giving to the poor side unless the agreement is made beforehand. In order to confirm the exact time period, I asked one Aussie friend, instead of answering my question, he sent me a link regarding De facto relationships, my god, I was nearly fainted, how can it be so complicated?

 

 

You know me; the most subject I hate was law at the Uni. I am here only for writing a blog for confirmed information, anyway, no worries how long. But one thing is certain, please don’t tell me you heart is breaking one day if you surprisingly receive a letter for attending the court, as a result, you might either have to sell your property or give half of money to the other side even no marriage relationship. I had one Aussie lady told me: “Don’t trust guys, they are all lazy and hopeless” after she lost her half house. And one Aussie guy said: “ All women are bad.” when he lost half of his fortune, as he is a very hard-working man and his wife is a drunk, they just being together for many years for having 1 kid with no marriage certificate. The situation is the same married or not married. So please don’t try to change your fortune from marrying a rich person, rich people are more cautious for being cheated, they are not stupid.

 

In this case, a rich person is not necessarily as fortunate as a poor one. As a poor person, someone loves you, most likely that’s true love, for a rich one, you never know, someone is interested in yourself or getting benefit from you unless the financial status is similar for a couple.

 

I used to hate regulations very much, as I mentioned in one blog “I love my home in Melbourne”, I rent an apartment the first 2 years. I was really frustrated the time when I moved in. I had to book the date with our reception for moving my furniture, and the time was limited: must move after 8:00am, no weekends available (now it’s getting better), the problem was the furniture I bought at IKEA, I was informed the delivery time was before 8:00am. How it could be possible, one before 8:00am, the other was after. I discussed with both side, the response was: “Sorry, we can’t change time.” That stressed me out, I hate this country, and I really hate it. Lucky enough, that day, the delivery from IKEA was delay because of accident happened.

 

However, every year when I was on holidays in Shanghai, I felt very uncomfortable whenever I saw the scratches or marks on the stairs or the elevators from both mine and my parents’ apartment. I was wondering why it was so careless, where’s the body corporate? Were they on duty?  Why they left common area look so dirty without considering paint it new every a few years as the labour is not that expensive in China.

 

 

I gradually realizing and appreciating the rules in Australia. For making appointment purpose of moving, because the elevators can be protected from damaging after covering all the sides. And there’s time limitation as most employees need to get work on time before 8:00am including myself at the moment.

 

 

 Again what I wrote on “I love my home in Melbourne.” I was annoyed for being checked rooms twice a year by the real estate agent guy as that’s the law, you can’t say no. or even the owner ask you move out, they will have to send you a notification letter 60 days earlier, as a tenant will give 30 days’ notice for ending contract, and you are supposed to keep the apartment as clean as the time you moved in. I remember I paid AUD250 for someone cleaning and steaming the carpet when I was gonna move out. The real estate guy was satisfied after I showed him the invoice for the evidence of cleaning. I was not happy about paying such amount of money only for cleaning.  However, since I was an owner, I see things differently, and I recon the tenant should keep the room clean and tidy, just show your respect and duty.

 

 On the other side, In China, I don’t think it is as restricted as in Australia. Sometimes you will find it completely a nightmare when someone moves out, the tenant might mess up everywhere, and they would have never had a sense to clean it before return the key. Where you can complain? There are such a big population, the law is not so specific, and nobody cares much about law.

 

 

 Once you are used to the laws, you won’t feel it exist, you will be very uncomfortable if there’s no regulations. At the beginning of this year, when I was in shanghai, I made a plan for running every day from my Parents’ place to my apartment, but after 1 day, I gave up as I found it was too hard for me walking on the road, nobody stopped for me, even the green lights were on sometimes. I felt relief after back to Melbourne, whenever I walk along the pedestrian crossing, cars will stop immediately. Some drives are kind and nice waiting for you pass, but the most important element is law. If the drivers don’t stop, they will get fined or even worse at the risk of losing driving license.

 

 Where there’s law, the opportunities are equal, no matter you are new to the country, or how low your social status is, you will be treated the same as anyone else. If you can’t afford a lawyer, there’s free ombudsman who can protect you under certain circumstance. I like it this way, now I can’t live without laws.

I wonder if my mind and yours is linked somewhere. Few days ago, I was just thinking about the laws, rules and regulations that could bankrupt us. Laws are certainly necessary as there are rights and responsibilities in every society. Rules are made to be observed and obeyed. I wanted to study law but my mom don't allow me because she said lawyers defend thieves and murderers. How amusing.

The most shocking is the co-habitation law which states that if you cohabit with a person for 7 years, your status becomes same as a married couple. Once you separate of divorce, you have to give half of your house or whatever you posses to opposite side. You may also have to pay alimony to the opposite for years.

I knew this years ago, so I have always been careful in associating with others. It is highly likely to have some trouble in the relationship and end up with deep regret. Even written nuptial agreements (marriage agreements) are useless as my city don't recognize them. The people who made those laws don't know what is fairness in these matters. The assets of a person before marriage should never be touched as it has nothing to do with others. Those assets acquired after marriage can be shared. So, if some Romeo or Juliet approach you, it is better to think twice before you fall in love.

It is better to remain single than to involve in a relationship that can complicate and cripple our lives. I am terrified by these rules and when friends ask me why I stay single, this is one of the reasons. So, as you can see there are so many pitfalls in relationships, people are quite concerned. When you have some property, wealth or savings, there would be minefields and traps around you, so it is not really that comfortable to be wealthy.

It is normal that we like the laws that benefit us and dislike the laws that are not beneficial to us, but all these rules are complicating our lives. Why can't we have simple rules like our parent's time because they can stay together long.

The view from your apartment is worth millions. It would be so refreshing to see this to start a day instead of all those concrete buildings we see in other apartments. Don't try those hot air balloons because there are extremely dangerous and all they rely on is a small gas cylinder. Anything happens you would fall and break your bones. Don't try it dear.

sometimes, marrige mor relationship doesn't do with the property or assets. one person who gets a half of property from the divorce still has the  heart - breaking devastation 。I mean money can't heal the bad marrige. or discovery from the mental heart. we should consider the  cost of time and Spiritual input ,not just the property. marrige is  linked to the responsibility.if it is much involved to the assets or money. I think the marrige lose the basic meaning .if We  try to avoid the relationships with others for the lose of property, then,we may keep single for long. after many years, we may find we lose the taste and experience of youth.we don't know how to love and company others.sometimes, we need experiences to tell us what is good for us and what is suited for us.

Did not know much of that relation. Whatever the poor or the rich, nowadays people are becoming wiser. Particularly for those who have nice social status and procession, are aware of their lawful assets. So, it is not that easy just by breaking up from cohabitation or ending up a relation between a boy and girl. Most of them allocate and transfer their assets into many funds operated by some trust companies. Some other belongs or housing would also be kept in many other forms, such as in the form of notarizing on the behalf of someone's account, designated succors from some insure polices, etc.

I do not know much of that situation in Australia, while in most cases, at least, in our land, such a thing does not happen. At most, there comes to an agreement by paying some fees on the basis of mutual reconcile in volunteer.

The problem of apartment renting is just a nightmare for most guys here. The contract usually does not follow its agreement, and landlord would easily to break rules by informing there is a rent rising. If the tenant is not able to afford, he would be asked to move out. Another side is some tenants do leave bad impression by messing up the house and leaving everything dumped on the floor.

Thus, we still have a lot to learn from developed countries.

You are still lucky , 7 years in HongKong, it is only 2 years in Australia will be regarded as de facto relationship, it was less than 2 years previously I’ve heard.

So one my Aussie friend who lost half property, just kidding, next time find one girlfriend, after 1 year or so, throw her away, she can’t get anything from you. So if some rich new immigrants move to Australia, if they have idea about the law, they might have a risk of losing half fortune, then get heart attack.

Therefore, in Australia, there are a big amount of people stay single, own good money, being very independent. They don’t wanna bother for getting married.
For a rich person, the more divorces, the poorer he or she will be.

7 years is still long enough if a relation is not that serious, you still have time say good bye without losing property. For a marriage relationship, 7 years is pretty short, after having kids, find both are not happy for being together, if divorce, a guy will get less percentage than a lady, as he has to pay for the kids, unfortunately, a guy will lose both property and kids if they stay together with Mum.

One solution, you can only fall in love with someone as rich as you. A poor person has more choices in a relationship.

Thanks, actually, an apartment is more affordable in Melbourne, in Shanghai, probably, only a very rich person can afford to buy a spectacular harbour view one, in Melbourne, some very rich people live in the house along the seaside, an apartment is not that competitive, it is only a choice where you like to stay.

Thanks for reminding me, I was a bit scared for taking a hot balloon so I have never tried.

You are right, for a young girl, you don’t have to worry about property sort of thing as it belongs to your parents,

but for a middle aged or a wealthy person, they have to consider about it, as they can’t afford lose both a relationship and property, that will cause them triple sadness. With the money, they can live in a very comfortable lifestyle, otherwise, they have to restart from the bottom. Unlike young ones, the middled aged or elder ones don’t have enough energy or not willing to start from that level again.

You can experience life whatever you like, but for example, if your dad give you 2 apartments, where you live with a really handsome perfect dreamed boyfriend, however, he’s not as rich as you.  After 2 years, you wanna pursue your dream doing something you love, your boyfriend doesn’t happy about that, he stops you doing what you like. If you think your dream is more important than your boyfriend, then you might stop the relationship. But your boyfriend put you into court, and from law, he will get 1 apartment of you. What’s your feeling about that? What I am talking about is Australia law. It’s not Chinese law.

If you have no property, than you are lucky enough, just enjoy the life as much as you like.

This is really scary dear. Makes me shiver just to think about it. Whole life work hard, save up and invest rightly then you lost your life savings just because you find the other half unsuitable. Allow me to thank you for your well intentioned alert so that our friends don't fall into these pitfalls. A friendly reminder. Take care everyone, look before you leap.

Another scary law is about family assets. Anyone whose family have some assets are bound to have some trouble after the parents pass away. There would likely to be instant fights and arguments to grab money. The result is often breakup and alienation of family members. It is also hard for parents to distribute what they have before they leave this world. I have witnessed so much of this happening.

There are so many pitfalls out there, it is causes a lot of stress. Sometimes, I wonder if it is worthwhile working hard and be financially independent. One way or the other you may lose what you made in your lifetime.

In china, the law protect the rich, in Australia, it protect the poor, it is said after 2 years, if a couple live together, no matter marry or not, it will be treated the same as married ones. So it’s pretty risky for someone who is rich.

In China, it is mainly related to the moral standard, this is not the case in Australia, everything is law, so it is recommended to obtain law knowledge before start living  in Australia.

In Australia, rental is lawful, the landlord must follow the contract, otherwise, the tenant will put the owner into court. The rental can’t jump too much,  It can be increased at a reasonable percentage each year . Both tenant and owner are required to give notification for stop renting. Anyway, the rental price compared to the housing price in China is very cheap.

Everything fits the law here, that’s how lawyer earn big money.

Rich doesn’t mean true happiness, the richer , the bigger family, the more complicated. It is easily for breaking the relationship between family members if parents can’t equally distribute the assets before they pass away.

Therefore, if there’s enough money for use, do things really enjoy from inner heart rather than thinking about making endless money by doing things hate.
